Terms and Conditions for Auto-Deposit

1. Introduction
1.1. These Auto-Deposit Terms and Conditions (“Terms”) apply to you in addition to the Skrill Account Terms of Use and the Privacy Notice. You must read them carefully and keep a copy for your future reference. By enabling and using the Auto-Deposit functionality (“Auto-Deposit”), You will be deemed to have accepted and be bound by these Terms.
1.2. In the event of any conflict between these Terms and the Skrill Account Terms of Use, these Terms will, to the extent of the conflict, prevail.
2. Functionality
2.1. The Auto-Deposit allows you to automatically fund your Skrill Account from your credit card and/or debit card when your Skrill Account Balance falls below an amount that you have determined in accordance with Clause 3 below.
2.2. The Auto-Deposit supports deposits with credit cards and/or debit cards only and is available to fully verified Skrill Accounts older than 180 days and registered in any of the eligible countries available here.
2.3 The Auto-Deposit is initiated on behalf of the Customer.
3. Setting Up an Auto-Deposit
3.1. To enable an Auto-Deposit, you need to provide us with the necessary information by filling in all mandatory parameters for the transaction in your Skrill Account, including but not limited to, the Auto-Deposit Amount, the Auto-Deposit currency, the Balance Threshold Amount, and any other parameters and information that we may require from time to time (collectively referred as “Mandatory Requirements”).
3.2. Upon completing the Mandatory Requirements, you need to initiate one successful Auto-Deposit to activate the functionality. Every subsequent Auto-Deposit shall be processed automatically without any additional action required from you.
3.3. We may change or add new Mandatory Requirements with a written notice to the email address registered with your Skrill Account. You must ensure that the updated Mandatory Requirements are correct and complete to avoid any disruption in the Auto-Deposit.
3.4. The introduction of changes to the Mandatory Requirements will cancel any then existing Auto-Deposits. In such cases you will need to enable the functionality again.
3.5. You must ensure that the Mandatory Requirements you have provided us with are correct and complete. Please note that the Auto-Deposit will not be enabled if any part of the Mandatory Requirements is incorrect and/or incomplete the Auto-Deposit.
3.5. An Auto-Deposit is restricted to only one Skrill Account and associated with one credit or debit card.
4. Fees
4.1 Auto-Deposits Transactions shall be charged as per the "Fees" section of our Website.
4.2. Auto-Deposits shall be processed in a currency of your choice, as selected by you from the currencies Skrill makes available from time to time upon setting up the Auto Deposit or in the currency of your credit or debit card issuer.
4.3. Auto-Deposits Transactions may be subject to currency conversion in accordance with the Skrill Account Terms of Use.
5. Confirmation and Cancellation
5.1. We shall notify you when your Auto-Deposit is enabled by sending you a confirmation email to the email address registered with your Skrill Account.
5.2. Prior to the initiation of an Auto-Deposit Transaction you shall receive a 15-minute notice via email or SMS registered with your Skrill Account. Within said period, you shall be able to cancel the respective Auto-Deposit Transaction by going to the My Account settings in your Skrill Account or by contacting Customer Support directly. Please note that, depending on your country of residence or other circumstances, upon enabling the Auto-Deposit, we may require you to state the purpose of your Auto-Deposit in order to initiate an Auto-Deposit Transaction.
5.3 If the credit or debit card used for the Auto-Deposit does not hold enough funds to cover the Auto-Deposit Amount, Skrill shall notify you in written that the transaction has failed.
5.4 If an Auto-Deposit reaches the daily card limits imposed by your credit or debit card provider, the Auto-Deposit shall fail. Skrill shall notify you of any such failure with a written notice.
5.5. You may cancel the Auto-Deposit feature at any time by going to the My Account settings in your Skrill Account or by contacting Customer Support directly.
6. Availability and Restrictions
6.1. The Auto-Deposit is available in specific countries. To use the Auto-Deposit you must be a resident of such country and have your Skrill Account registered in such country.
6.2. The list of eligible countries is available here. We may enable or disable the Auto-Deposit in countries in our sole discretion at any time. Where we have disabled the Auto-Deposit in the country where you reside, we will notify you in advance with a two months’ written notice sent to your email address registered with your Skrill Account.
7. Your Data
7.1. You acknowledge that for the purpose of providing the Auto-Deposit services to you we need to access, process, and retain any relevant information . This does not affect our respective rights and obligations under data protection legislation. You may opt out of this additional service by closing your Skrill Account. In this case, we will cease using your data for this purpose but may continue to process your data for other purposes where we have other lawful grounds to do so, such as where we are legally required to keep records of transactions.
7.2. The processing of your personal data is governed by our Privacy Notice which can be found on our Website.
8. Liability
8.1. Subject to clause 15 (“Liability”) of the Skrill Terms of Use and to the extent permitted by law, we shall not be liable for any loss you may incur arising out of any error you made when setting up the Auto-Deposit and/or using the service in breach of these Terms.
9. Changes to these Terms
9.1. We reserve the right to change these Terms at any time including the right to discontinue the Auto-Deposit feature completely.
9.2. Changes to the Terms will be communicated via e-mail to the primary email address registered with your Skrill Account. The proposed change will come into effect 2 months after the notice is deemed to be delivered (see section 17.1 of the Skrill Account Terms of Use), unless you give us written notice that you object to the proposed change. Your objection notice shall be deemed to constitute a notice to discontinue the use of the Auto-Deposit and these Terms will no longer apply to you.
10. Termination and Suspension
10.1. We may, in our sole discretion, suspend or terminate any Auto-Deposit without notice if we reasonably believe that: (i) you have breached these Terms or the Skrill Account Terms of Use ; (ii) your use of the Auto-Deposit is in fraudulent, including but not limited to, for money laundering, terrorism financing, or other activities that are in breach of Applicable Law; (iii) you are in violation of any law or regulation that is applicable to your use of the Auto-Deposit; (iv) an Auto-Deposit has been set up without your authorisation or fraudulently.
10.2. If suspension or termination occurs under Clause 10.1, we shall notify you either prior to the said action or, if prior notification is not possible under the circumstances, promptly after unless we are prohibited by law from notifying you.
11. Confidentiality
11.1 Confidential Information means any information which is marked as “Confidential” or should be reasonably expected to be confidential having regard to the context of disclosure or the nature of the information; including, without prejudice to the generality of the foregoing, business plans, data, strategies, methods, customer and client lists, technical specifications, transaction data and customer data shall be deemed confidential.
11.2 Skrill shall use and reproduce your Confidential Information (where applicable) only for purposes of the Auto-Deposit and only to the extent necessary for such purpose and will restrict disclosure of the Confidential Information to its employees, consultants, advisors or independent contractors with a need to know.
11.3 Notwithstanding the foregoing, it shall not be a breach of these Terms for Skrill to disclose Confidential Information if required to do so under law or in a judicial or governmental investigation or proceeding.
11.4 The confidentiality obligations in Sections 11.1. - 11.4. shall not apply to information that: (a) is or becomes public knowledge through no action or fault of Skrill; (b) is known to Skrill without restriction, prior to receipt from you in relation to the Auto-Deposit, from its own independent sources as evidenced by Skrill’s written records, and which was not acquired, directly or indirectly, from you; (c) Skrill receive from any third party reasonably known by Skrill to have a legal right to transmit such information, and not under any obligation to keep such information confidential; or (d) information independently developed by Skrill’s employees or agents provided that Skrill can show that those same employees or agents had no access to the Confidential Information received hereunder.
12. Definitions
Auto-Deposit Amount means the pre-set amount with which your Skrill Account shall be funded;
Auto-Deposit Transaction means a payment from your credit card or debit card to fund Skrill Account;
Balance Threshold Amount means the minimum Skrill Account balance set by you for Auto-Deposit;
