Skrill USA Invite Friends Program

The Skrill USA Invite Friends Program (“Invite Friends Program”) allows you (“you” or “Referrer”) to receive a Bonus, as defined herein, from Skrill USA for referring prospective New Members to sign up for a Skrill USA Account or Skrill Account, as the case may be.
Below are the terms and conditions (the “Terms and Conditions”), applicable to the Invite Friends Program. Please read them carefully. By referring a friend to the Invite Friends Program, you will be deemed to have accepted and be bound by these Terms and Conditions.
The Skrill USA Account Terms of Use, as amended from time to time, are incorporated into and form part of these Terms and Conditions and shall apply to you. In the event of any inconsistency between any of the provisions of the Skrill USA Account Terms of Use and these Terms and Conditions, to the extent of the inconsistency, these Terms and Conditions will prevail.
1. Definitions and Interpretation
1.1. Unless stated otherwise, capitalized words here shall have the same meaning as in the Skrill USA Account Terms of Use.
1.2. The following terms when used in these Terms and Conditions shall have the following meaning:
Applicable Laws and Regulations means any law, statute, rule, regulation, order, circular, decree, directive, judgment, decision or other similar mandate of any applicable federal, state or local governmental authority having competent jurisdiction over, or application to, the Referrer, a Referred Member, or subject matter in question.
Approved Media means social media websites (such as Facebook, Whatsapp Twitter, LinkedIn, Skype, Instagram), webpages, mobile platforms or applications. Email is expressly excluded from Approved Media.
Bonus means the ten-dollar ($10) bonus payable by Skrill USA to you for the referral of New Members to in accordance with Section 4.2 (Bonus). New Members may receive a bonus up to ten dollars ($10).
Member Account means the digital wallet account registered with Skrill USA or Skrill, in the name of a customer.
New Member means a consumer who, at the time of the referral by you to Skrill USA or Skrill, in accordance with Section 3 (Referrals), does not have an existing Member Account.
Prohibited Activities means the activities set out in Section 5 (Prohibited Activities) or any other activities notified to you by Skrill USA from time to time.
Referral Link means a link provided to you by Skrill USA through your Member Account for the purposes of allowing New Members to apply for a Member Account.
Referred Member means a New Member who was referred by you using the Referral Link, has registered a Member Account in accordance with the Skrill USA Account Terms of Use or Skrill Terms of Use, as the case may be, and who has successfully satisfied the Eligibility Criteria in Section 2.
Referred Member Account means the Member Account of a New Member that has been tagged to you for the purposes of generating a Bonus.
Skrill means Paysafe Payment Solutions Limited, a company regulated by the Central Bank of Ireland, or Skrill Limited, a company regulated by the Financial Conduct Authority, as the case may be.
Skrill Services means the services provided by Skrill which includes (but is not limited to) the issuance of electronic money and related payment processing services.
Skrill USA means Skrill USA Inc., a Delaware corporation, registered with FINCEN and with various states as a licensed money transmitter.
Skrill USA Services means the services provided by Skrill USA which includes (but is not limited to) the provision of a digital wallet account and related payment processing services for the purpose of the Member Account.
Tagged Account means the Member Account of a Referred Member that has been tagged to your Member Account for the purpose of generating Bonus(s).
1.3. The Skrill USA Account Terms Of Use, as amended from time to time, are incorporated into and form part of these Terms and Conditions and apply to the Referrer and the Referrer’s Member Account.
2. Eligibility Criteria
2.1. In order to participate in the Invite Friends Program, you must:
(i) have an active Skrill USA Account;
(ii) have acquired a True Skriller status following the steps shown here;
(iii) not use your Skrill USA Account for commercial purposes;
(iv) not be a service provider or a direct family member of a service provider of Skrill USA;
(v) be at least 18 years of age; and
(vi) reside in the United States.
3. Referrals
3.1. You shall co-operate in good faith with Skrill USA to promote and refer the Skrill USA Services and Skrill Services to New Members in accordance with these Terms and Conditions. You acknowledge and agree that Skrill USA may in its sole discretion decide whether or not to accept New Members as Referred Members.
3.2. The legal relationship between Skrill USA and any Referred Member will be the sole remit and responsibility of Skrill USA. With the exception of Section 4.2 (Bonus(s)) Skrill USA will not be liable to provide you any details of such relationships.
3.3. You shall not have any power to accept Referred Members or make contracts on behalf of Skrill USA and shall not make or give any promises, representations, warranties or guarantees, whether expressed or implied, to a New Member on behalf of Skrill USA.
4. Invite Friends Program – How It Works
4.1. Referral Link
Upon using the Skrill USA Service and satisfying the Eligibility Criteria you will automatically receive a Referral Link in the “Invite Friends” section of your Skrill USA Account that can be shared with friends and family members in order for you and them to become eligible for and receive Bonuses.
4.2. Bonus
(i) You can earn a Bonus if: (i) a prospective Referred Member clicks on your Referral Link to create an eligible New Member Account that complies with the Skrill USA Account Terms of Use, or Skrill Terms of Use, as the case may be, and thus becomes a Referred Member; and (ii) the Referred Member satisfies the Eligibility Criteria. If (i) and (ii) are fulfilled, both you and the Referred Member will receive a Bonus that can be used in your next transaction.
(ii) You may invite any number of friends and family to use the Skrill USA Services or Skrill Services but you will only receive Bonuses to the aggregate amount of two hundred dollars ($200) for all Referred Members. Once that amount is hit, you will no longer be eligible to receive further Bonuses but, if you wish, you may continue referring prospective New Members to Skrill USA or Skrill.
(iii) All Bonuses are paid inclusive of taxes, where applicable. Skrill USA shall not be responsible for any taxes, duties, assessments, fines or levies or other amounts payable by you to any governmental or regulatory authority arising out of your participation in the Invite Friends Program. You are responsible for reporting any taxes owed in relation to revenues earned through the Invite Friends Program.
(iv) Skrill USA reserves the right to change the applicable Bonus by giving you twenty-one (21) days’ written notice sent to the primary email address registered to your Skrill USA Account.
(v) Skrill USA shall also in its sole discretion have the right to withhold all or part of any payment of the Bonus where it reasonably suspects or knows that any of the Prohibited Activities referred to herein has taken place.
(vi) For the purpose of calculating the Bonus, Skrill USA reserves the right to disregard all activities that Skrill USA, in its sole but reasonable discretion, deems an abuse of the Invite Friends Program, including but not limited to:
a) transactions that are prohibited under these Terms and Conditions; or
b) transactions that are prohibited under the Skrill USA Account Terms of Use.
4.3. Sharing Referral Links
(i) Referrer can share a Referral Link: (1) by copying and sending it to prospective Referred Members; or (2) by sharing a link on Approved Media.
(ii) Referral Links must only be used for personal and non-commercial purposes. Referral Links must only be published or distributed on Approved Media. Referrers are prohibited from “spamming” anyone with referral invitations or posting their Referral Links as well as any personal data of the prospective Referred Members on third parties’ websites. This includes bulk emailing, texting or messaging unknown people as well as using automated systems or bots through any channel for the purpose of distributing your referral link. You are strictly prohibited from paying to advertise their referral links. Skrill USA reserves the right to sanction any such activity in its sole and reasonable discretion.
5. Prohibited Activities
5.1 You shall not, and shall ensure that Referred Members do not, perform any of the following activities:
(i) open or operate multiple Member Accounts without the prior written consent of Skrill USA;
(ii) register a Member Account on behalf of another person;
(iii) offer incentives or rewards to New Members to encourage them to apply for a Member Account;
(iv) create or employ any mechanism designed to artificially or automatically generate sign-ups to the Skrill USA Services, Skrill Services or the Invite Friends Program;
(v) take any action designed to or which is likely to induce, encourage or cause any Referred Member to modify their existing terms with Skrill USA or Skrill Limited, as the case may be, or to terminate their existing relationship with Skrill USA or Skrill for any purpose, including for the purpose of re-registering such Referred Member so as generate additional Bonuses;
(vi) use counterfeit, forged, imitated, stolen or otherwise altered identification documents;
(vii) cause, endorse, advise or approve any type of practice that enables itself or Referred Members to breach or circumvent any of Skrill USA or Skrill ’s security or verification or other compliance procedures, which includes, but is not limited to, making fraudulent or abusive transactions, and opening multiple accounts in breach of the Skrill USA Account Terms of Use, Skrill Account Terms of Use, these Terms and Conditions, as well as any other terms and conditions available on Skrill USA’s webpages as such terms and conditions pertain to the operation of the Invite Friends Program;
(viii) use or create any material that is sexually explicit, offensive, profane, hateful, threatening, harmful, graphically violent, defamatory, libellous, harassing, or discriminatory (whether based on race, ethnicity, creed, religion, gender, sexual orientation, or physical disability);
(ix) make or knowingly benefit from transactions which Skrill USA in its sole discretion deems to be suspicious, unauthorized, fraudulent or malicious including without limitation transactions that relate to money laundering, terrorism financing, fraud or other illegal activities;
(x) use email for the distribution of a Referral Link; or
(xi) conduct any activity that is in breach of the Skrill USA Account Terms of Use.
5.2 Skrill USA may terminate, with immediate effect, any relationship under these Terms and Conditions where Skrill USA has detected, in its sole but reasonable opinion, abuse of these Terms and Conditions. Skrill USA further reserves the right to amend, suspend or terminate these Terms and Conditions at any time, without notice, should there be any risk to the continued security, fairness or integrity of the Invite Friends Program.
6. Warranties
You warrant, represent and undertake to Skrill USA that:
(i) you shall not engage in the distribution of any bulk emails (spam) in any way mentioning or referencing Skrill USA or Skrill or any Skrill USA or Skrill products or services;
(ii) you shall comply with all Applicable Laws and Regulations;
(iii) you shall not breach or attempt to circumvent Skrill USA’s security or verification procedures; and
(iv) you shall only share your Referral Link with third-parties, who have consented to be so referred, in order that they may sign up for a Skrill USA Account or Skrill Account, as the case may be. You shall not refer any consumer to Skrill USA or Skrill who has not given their agreement to be so referred.
7. Privacy and personal data
7.1. Processing of personal data is governed by the Skrill USA Privacy Notice. Additional information may be required by Skrill USA to verify compliance with these Terms and Conditions.
7.2. Within your Skrill USA Account you will be able to see the details of the Bonus earned in respect of each of your Referred Members. You must obtain consent from each of your Referred Members to view this information prior to referring them. By using the Referral Link you are confirming that you have obtained such consent from the Referred Member.
8. Changes to Terms and Conditions
8.1. Skrill USA reserves the right to change these Terms and Conditions, at any time, including the right to terminate the Invite Friends Program completely.
8.2. Subject to Section 8.3 below, changes will be communicated via e-mail to the primary email address registered to your Skrill USA Account. The proposed change will come into effect twenty-one (21) days after the notice is deemed to be delivered (see Section 25 of the Skrill USA Account Terms of Use), unless you give us written notice that you object to the proposed change. Your objection notice shall be deemed to constitute a notice to terminate your participation in the Invite Friends Program and these Terms and Conditions will no longer apply to you.
8.3. The twenty-one (21) days’ notice period shall not apply where we believe, in our reasonable opinion, that the change neither reduces your rights nor increases your obligations. In such instances, the change will become effective immediately without prior notice.
9. Termination
9.1. Skrill USA reserves the right to end the Invite Friends Program at any time in its sole discretion by giving you twenty-one (21) days written notice sent to the primary email address registered to your Skrill USA Account.
9.2. In the event Skrill USA ends the promotion under Section 9.1 of these Terms and Conditions, Skrill USA shall continue paying the Bonus in respect of your existing Referred Members until Skrill USA’s liability to pay Bonus has expired in accordance with Section 4.2 or 5.2 of these Terms and Conditions.
9.3. Skrill USA may immediately terminate your participation in the Invite Friends Program in the following circumstances:
(i) you commit a material breach of these Terms and Conditions or the Skrill USA Account Terms of Use; or
(ii) Skrill USA in its sole but reasonable discretion believes you or one of your Referred Members has conducted a Prohibited Activity as set out in Section 5 of these Terms and Conditions;
9.4. If Skrill USA terminates your participation in the Invite Friends Program under Section 9.3 of these Terms and Conditions, Skrill USA shall stop paying Bonus to you immediately upon termination.
10. Dispute Process/Limitation of Liability/Indemnification
If for any reason you believe that there is a discrepancy regarding your Bonuses, please contact us. Skrill USA may require you to submit additional information in order to make a determination regarding a Bonus. Skrill USA shall use reasonable commercial efforts to investigate and resolve any errors or discrepancies and pay any outstanding Bonus to you. All decisions regarding your Bonus will be final and at Skrill USA’s sole discretion. To the extent permitted by law, you hereby release and discharge Skrill USA from any and all liability with respect to paying any unpaid Bonuses that may otherwise have been payable to you.
11. General
11.1. These Terms and Conditions, and any complaint, claim or controversy arising out of or relating thereto, shall be governed by the laws of the United States and the state of Florida, without regard to conflicts or choice of laws principles, whether or not you live in Florida. Any dispute under these Terms and Conditions or otherwise in connection with your Skrill USA Account shall be brought exclusively as set out in Section 26 of the Skrill USA Account Terms of Use.
11.2. If there is any discrepancy between any translated version and the original English version of these Terms and Conditions, the English version shall prevail.
11.3. The Invite Friends Program shall not be construed to create any employment relationship, agency relationship or partnership between you and Skrill USA.
11.4. If any part of these Terms and Conditions is found by a court of a competent jurisdiction to be invalid, unlawful or unenforceable then such part shall be severed from the remainder of the Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
